  • Lowell was neglected
  • Faxon had no right to attempt anything without first consulting a doctor who was more qualified
  • Dislocations were common, and any doctor should know how to diagnose and treat them
  • The hip was never properly set by the defendants
  • Faxon did all that could have been expected of a rural practitioner
  • Faxon was frankly just as successful as the Boston contingent: Warren was not able to reduce the dislocation either
  • According to testimony by Dr. Nathan Smith there was no dislocation
  • Smith also added that though he had only treated one hip dislocation he was able to reduce it without the aid of pulleys
  • According to Sir Astley Cooper there is no such thing as a downwards and backwards dislocation into the ischiatic notch
  • There are no previous examples anywhere of a dislocation of that nature
  • They brought in a witness to testify that Lowell walked a long distance home only 14 days after the accident when he ought to have been in bed
